  1. DEFINITIONS 

1.1 In these Terms and Conditions the following words and expressions shall have the following meanings: 

"We", "Us", "Our" “Wilsons” shall refer to Wilsons Epsom whose registered number is 272743 and registered office is: Kiln Lane, Epsom, United Kingdom, KT17 1DH. 

"You" and "Your" shall refer to you personally, being the customer or prospective customer desiring to buy vehicle parts or accessories from us and any user of the Website.

“Order” means the process by which You may purchase a vehicle parts or accessories from us

“Online” means Your purchase of a vehicle parts or accessories by means of a distance contract which is concluded without any face-to-face contact between You and Us, including but not limited to purchases concluded through the Website, by email or over the phone.

"Payment Method" is via Stripe or Credit card. Cash payments are not accepted.

"Personal Data" is Your personal data as defined in the General Data Protection Regulation (EU) 2016/679. 

“Price” is the total amount payable for the vehicle parts or accessories inclusive of VAT.

"Privacy Statement" the privacy statement set out https://www.wilsons.co.uk/wilsons-privacy-policy which forms part of this Contract

“Terms and Conditions” these Wilsons vehicle parts or accessories Terms and Conditions together with the Terms of Use and Privacy Statement

“Terms of Use” the Wilsons Website terms of use set out at https://www.wilsons.co.uk/terms-and-conditions which form part of these Terms and Conditions. 

“Vehicle parts or accessories)” are the items that are available for sale from Wilsons together with any ancillary products or services.  

"Website" is the website owned and operated Wilsons located https://www.wilsons.co.uk/  plus any related URLs owned and operated by Wilsons which enable the provision of details of vehicle parts or accessories for sale by Wilsons.  

1.2 Headings in these Terms and Conditions are only for convenience and shall not affect its construction. 

These Terms and Conditions are only available in English. No other languages will apply to these Terms and Conditions. 

  1. INFORMATION WE GIVE YOU 

2.1 By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that We must give You certain key information before a legally binding contract between You and us is made. This key information is set out in these Terms and Conditions which will also be supplied to You as a pdf attachment following an Order made by you online detailed in clause 4.3. 

2.2 If We have to change any key information once a legally binding contract between You and Us is made, we can only do this if You agree to it.

3 VEHICLE PARTS AND ACCESSORIES PRICING AND DESCRIPTIONS

3.1 vehicle parts or accessories Descriptions are provided for information for you to be able to consider. We make every effort to ensure that the vehicle parts or accessories descriptions are accurate but may not address Your particular requirements. Where you require additional information in relation to specific vehicle parts or accessories, please contact us by telephone or email so we may further assist you.  You should check with us to ensure the specifications meets your expectations prior to committing to purchase.

3.2 We make every effort to ensure that the prices and figures shown on the Website and on other advertising media are accurate. However, errors may occur, and We may change prices without notice. We will inform You as soon as reasonably possible if there is an error in the price of the vehicle parts or accessories that You have ordered. 

You may then either

(a) re-confirm Your order at the correct price or 

(b) cancel Your order. 

If You decide to cancel Your order after We have informed You of a pricing change, We will give You a full refund of any monies you have paid as soon as reasonably possible (and in any event within fourteen (14) days of cancellation). 

3.2.6 We make every effort to ensure the accuracy of the information contained in the Website, vehicle parts or accessories descriptions and other advertising media however, errors may occur.  (See paragraph 3.2.1)

3.2.7 We have made every effort to display the vehicle parts or accessories accurately on our website with images, but we cannot guarantee that the photographs accurately reflect the appearance of the vehicle parts or accessories.

4. Product Warranty

4.1 We want you to enjoy your purchase with complete peace of mind. Genuine parts and accessories have a 12-month, unlimited mileage manufacturer warranty. Within the period of time or mileage, where specified. We will endeavour to exchange or replace, those parts or components which are covered by the warranty and which may prove defective in materials or workmanship. Warranty does not cover incorrect fitment or damage caused during fitment or delivery. For further details please refer to the Warranty booklet and Owner’s manual provided with the vehicle or contact your local dealership for further advice.

4.2 You can submit a warranty claim by contacting us via e-mail and we will review the claim. If the claim is valid/successful, we will replace the defective product. Please provide proof of purchase from our online store. In addition, we will require images of the defective product and an explanation of the issue. Including the vehicles current mileage, mileage upon installation and the vehicles full chassis number (VIN).

5. Refunds

5.1 If items are returned via courier or the Post Office, we aim to process refunds within 5 working days. However; please allow up to 14 days from return for your account to be credited.

5.2 We will offer to exchange/collect items sold and/or fulfilled by Wilsons Online Shop, up to our standard delivery option cost, if: • you received an incorrect item, or • you received a damaged item, or • you received a defective item, or • you received an item that does not match its description In accordance with your statutory rights, if you received an item sold and/or fulfilled by Wilsons in Online Shop that is either incorrect, damaged, defective or does not match its description, we will either offer you the option to exchange the product via our chosen pre-paid carrier, or, if that's not possible and the cost of returning the item exceeds our standard delivery option, please contact us prior to returning.

We will not process a refund, for any additional postage costs you incurred, should we not be contacted in advance to returning goods. In any circumstances wherby a return is agreed in advance by both parties by a third-party other than our chosen returns methods, note that we will require proof of postage in order to refund such additional postage costs.

6. Late Delivery Terms & Conditions

6.1 We will not be liable to you for any loss, damage, non-delivery, mis-delivery or delayed delivery of a Consignment or for any failure or delay in the performance of the delivery services under these conditions due to an event beyond our reasonable control including, without limitation, any -

6.1.1 delay or cancellation of shipments, ferries, flights, railway or other transport;

6.1.2 failure of a Consignee to accept delivery of a Consignment;

6.1.3 delays in or refusal of securing customs clearance;

6.1.4 acts of God, acts of government or other authorities, war, riot, civil commotion, malicious damage to property, blockades, strikes, lockouts or other industrial disputes (whether involving our workforce or that of a third party) compliance with any law or governmental order, rule, regulation or direction, seizure under legal process, national emergencies, fire, flood, tempest storm or other weather conditions making provision of the Services impracticable, accident, breakdown of plant or machinery, default of suppliers (including, without limitation, fuel) or subcontractors

7. Liability For Late Delivery

7.1 If for whatever reason, a Consignment is not delivered on time, we will:

7.2 deliver the Consignment as soon as possible thereafter

7.3 We accept no liability for late delivery of any Consignment using the standard next-day service due by our 3rd party couriers

7.4 Should we provide you with a premium service (UK only) outside of the standard services offered i.e next-day before 12pm and not meet the service criteria, we will asses all consignments on a case by case basis.

8. Missing Deliveries

8.1 All claims that goods have not been delivered to you by our appointed carriers must be made within 7 days of the expected delivery date. We reserve the right to raise appropriate investigations with our carrier within a reasonable timescale. In some cases, we may require compelling evidence from you or a third party to aid the investigation process. You will be notified of our decision (to refund, replace or issue a credit for the goods) within 14 working days of your initial claim.

12. Changes to This Agreement

12.1 Wilsons reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed sever-able and shall not affect the validity and enforce-ability of any remaining condition.
